Terms of Service

1. Acceptance of Terms

By downloading, installing, or using the ApexTrack mobile application ("App"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the App. ApexTrack is a division of Twisted English LLC.

2. Description of Service

ApexTrack is an AI-powered athletic performance analysis application that provides video recording, AI coaching feedback, performance metrics, and progress tracking across multiple sports. The App is available on iOS and Android devices with optional smartwatch integration.

3. Eligibility

You must be at least 13 years of age to use ApexTrack. Users under 18 require parental or guardian consent. Parental consent is required for minors to participate in the referral rewards program.

Family Plan eligibility: The plan owner is responsible for ensuring that any member they invite meets the minimum age requirement of 13 years. By sending an invitation, the plan owner represents that the invitee is eligible to use the App under these Terms.

4. Accounts

You may sign in using Google Sign-In, Apple Sign-In, or email authentication. You are responsible for maintaining the security of your account credentials and for all activity under your account.

5. Subscription Plans & Payments

Free Tier: 10 AI analyses per 30-day rolling period, up to 10 saved clips.
Top-Up: Purchase additional analysis credits at $4.99 per 10 analyses. Credits do not expire.
Unlimited Monthly: $9.99/month for unlimited AI analyses, unlimited local clip storage, optional cloud sync, and premium features including meet preparation, focused reports, coach voice selection, and shareable PDF reports. Includes up to 100 cloud video backups.
Unlimited Yearly: $79.99/year (equivalent savings of 33%).
Family Plan Monthly: $19.99/month for up to 3 accounts (1 plan owner + 2 invited members). Includes all Unlimited features for every member, 200 shared cloud videos, and mandatory automatic cloud backup. Each member's coaching data, sessions, and videos remain entirely private to that member.
Family Plan Yearly: $159.99/year (equivalent savings of 33%).

Family Plan — additional terms:

The plan owner invites members by email; invitations expire after 7 days.
A member may leave the plan at any time from the app. The plan owner may remove members at any time.
On cancellation, removal, or a member leaving: that member's cloud videos are purged from the shared pool and the member reverts to the Free tier (10 analyses/month, 10 clip cap). Local device copies are never deleted.
If the plan owner cancels their subscription, all members' cloud access is revoked at the end of the current billing period. All members receive email notification when a cancellation is initiated.
Existing Unlimited subscribers who accept a Family Plan invitation have their individual Unlimited subscription cancelled automatically upon acceptance. No pro-rata refund is issued for any unused portion of the prior Unlimited subscription.
The plan owner cannot view any member's performance data, session history, videos, coaching feedback, or trophies. The 200 shared cloud video allocation is a capacity limit — each member's videos are stored privately and are not accessible to other members or the plan owner.
The plan owner is responsible for the full subscription cost regardless of how many member seats are occupied.
Both the plan owner and the affected member receive push and email notifications on the following events: invitation accepted, member leaves, member removed by owner.

Payments are processed by Apple on iOS App Store purchases and by Stripe on web purchases at apextrack.app. Apple subscriptions are managed in iOS Settings → Apple ID → Subscriptions. Stripe subscriptions are managed via the Manage Subscription link in the app or at apextrack.app/account. Subscriptions auto-renew unless cancelled at least 24 hours before the end of the current billing period.

6. Refunds & Cancellations

Monthly subscriptions: Non-refundable once the billing period begins. You may cancel at any time from the Manage Subscription link in the app; cancellation takes effect at the end of the current paid period.
Annual subscriptions: May be eligible for a pro-rata refund within 14 days of the initial purchase — contact support@apextrack.app to request one. After 14 days, annual subscriptions are non-refundable but remain active until the end of the paid year.
Top-Up credits: Non-refundable once purchased. Credits do not expire.
Voluntary account deletion: Unused analysis credits and any rewards balance are forfeited upon voluntary account deletion and have no cash value.

7. Referral Rewards Program

Each user receives a unique QR code and referral link. When a referred user upgrades to a paid subscription, the referrer earns $1.00 in rewards. Rewards can be cashed out at a minimum balance of $10.00 via Cash App. Stripe (web) subscribers may alternatively apply credit toward their next subscription bill at any time; Apple App Store subscribers can only redeem via Cash App because Apple controls in-app pricing. Rewards are personal and non-transferable. ApexTrack reserves the right to modify, suspend, or discontinue the referral program at any time.

Tax responsibility: You are solely responsible for any taxes applicable to rewards you receive. ApexTrack may be required by law to report reward payments to tax authorities — including filing IRS Form 1099 for US users who receive $600 or more in rewards in a calendar year. By requesting a cash-out, you agree to provide accurate personal information as required for any applicable tax reporting.

8. Your Content & Data

Unlimited tier — cloud storage is opt-in. By default, your data stays on your device. You decide when (and whether) to enable cloud sync, and you can turn it off at any time in Settings.
Family Plan — cloud backup is mandatory. By purchasing or accepting a Family Plan, you acknowledge and consent to automatic cloud backup of your session data, trophies, and video clips. The cloud sync toggle is not available on the Family Plan.
When cloud sync is active, your session data, trophies, pinned video clips, and meet data are stored securely in our backend (Supabase) and are accessible only to you.
Video frames sent for AI analysis are processed by Google Gemini and are not retained after processing.
You retain ownership of all content you create within the App.
You can delete your account and all associated cloud data at any time from Settings.

9. Acceptable Use

You agree not to:

Use the App for any unlawful purpose
Attempt to reverse-engineer, decompile, or extract source code from the App
Abuse the referral program through fraudulent or artificial means
Interfere with or disrupt the App's services or infrastructure
Share your account credentials with others

10. Intellectual Property

ApexTrack, its logo, design, and all related content are the property of Twisted English LLC and are protected by applicable intellectual property laws. You may not use our branding without prior written consent.

11. Disclaimers

ApexTrack provides AI-generated coaching feedback for informational purposes only. It is not a substitute for professional coaching, medical advice, or athletic training. Use the App at your own risk. We are not liable for injuries that may occur during training.

The App is provided "as is" without warranties of any kind, express or implied.

12. Limitation of Liability

To the maximum extent permitted by law, ApexTrack and Twisted English LLC shall not be liable for any indirect, incidental, special, or consequential damages arising from your use of the App, including but not limited to loss of data, revenue, or profits. Our total cumulative liability to you for any claim arising from use of the App shall not exceed the amount you paid us in the 12 months preceding the claim.

13. Indemnification

You agree to indemnify and hold harmless ApexTrack and Twisted English LLC, its officers, directors, and employees from any claims, damages, or expenses (including reasonable legal fees) arising from your use of the App, your violation of these Terms, or your infringement of any rights of a third party.

14. Governing Law & Dispute Resolution

These Terms are governed by the laws of the State of Georgia, United States, without regard to conflict of law principles. Any dispute arising from these Terms or your use of the App shall first be attempted to be resolved informally — contact us at support@apextrack.app and we will attempt to resolve the matter within 30 days. If not resolved informally, disputes shall be settled by binding individual arbitration under the rules of the American Arbitration Association, conducted in Canton, Georgia. You and ApexTrack each waive any right to a jury trial and any right to participate in a class action lawsuit or class-wide arbitration.

15. Termination

We may suspend or terminate your account at any time for violation of these Terms. Upon termination, your right to use the App ceases immediately. Unused analysis credits are non-refundable upon termination for cause.

16. Changes to Terms

We may update these Terms from time to time. Continued use of the App after changes constitutes acceptance of the revised Terms. We will notify users of material changes through the App or via email.
