Privacy Policy

1. Overview
ApexTrack, a division of Twisted English LLC ("we", "our", "us"), is committed to protecting your privacy. This Privacy Policy explains what data we collect, how we use it, and your rights regarding your personal information when you use the ApexTrack mobile application ("App").
2. Data We Collect
2a. Information You Provide
- Account information: Name, email address, and authentication credentials (via Google Sign-In, Apple Sign-In, or email).
- Athlete profiles: Athlete name, date of birth (for age verification), sport preferences, and training settings.
- Payment information: Processed by Apple on iOS App Store purchases and by Stripe on web purchases at apextrack.app. We do not store credit card numbers.
- Referral data: Your unique referral code, referral history, and rewards balance.
- Payout information: If you request a rewards cash-out, we collect your Cash App username solely to process the payment. This identifier is stored securely and used only for payout fulfilment and any required tax reporting.
- Family Plan data: If you are a plan owner, we store the email addresses of members you invite and their invitation/membership status. If you are an invited member, we store the email address used for your invitation.
2b. Information Collected Automatically
- Performance data: AI-generated metrics, scores, session summaries, coaching feedback, and progress trends.
- Device information: Device type, operating system version, and app version for compatibility and support.
- Push notification tokens: Device tokens used to deliver coaching tips, session reminders, and account notifications (with your permission).
- Usage data: Feature usage patterns and session frequency to improve the App experience.
2c. Information We Do NOT Collect
- Location data: We do not track your GPS location.
- Contacts: We do not access your contacts list.
3. How We Use Your Data
- To provide AI coaching analysis and personalised performance feedback
- To track your progress and generate session summaries over time
- To manage your account, subscriptions, and analysis credits
- To process referral rewards and cash-out payments
- To send push notifications about coaching tips, session reminders, Family Plan events, or account updates (with your permission)
- To fulfil any applicable tax reporting obligations
- To improve the App's features and performance
4. AI Video Analysis
When you record an attempt, selected video frames are sent to our AI service for analysis. These frames are processed in real time to generate your coaching feedback and metrics. Video frames are not stored after analysis is complete. The AI-generated results (scores, coaching text, drill recommendations) are stored in your account to build your progress history.
5. Cloud Storage — Your Choice, Your Control
Unlimited tier: You are in full control of what is stored in the cloud. By default, ApexTrack keeps your data on your device only. Cloud backup is disabled until you explicitly turn it on in Settings. You can toggle it off at any time.
Family Plan: Cloud backup is mandatory and permanently enabled for all Family Plan members. The sync toggle is not available on the Family Plan. By purchasing or accepting a Family Plan, you acknowledge and consent to automatic cloud backup of your session data, trophies, and video clips.
When cloud sync is active, the following data is stored securely in our backend:
- Session data: Metrics, scores, coaching notes, drill history
- Pinned video clips: Video files you choose to save and back up
- Trophy and progress state
- Meet preparation data
You can delete your cloud data at any time by deleting your account. If your subscription lapses, we keep your cloud data for 90 days in case you return, after which it is permanently purged.
6. Family Plan — Data Privacy
The Family Plan is designed so that each member's data remains entirely private. Specifically:
- Member data isolation: Each member's performance data, session history, coaching feedback, video clips, and trophies are accessible only to that member. No other member — including the plan owner — can view, access, or export another member's data.
- What the plan owner can see: The email addresses of invited members and whether each invitation has been accepted. Nothing more.
- What the plan owner cannot see: Any member's sessions, metrics, AI coaching, videos, trophies, or any other performance data.
- Shared video pool: The 200 shared cloud video allocation is a combined capacity limit. It is not a shared folder — each member's videos are stored in a private, isolated bucket and are not visible to others on the plan.
- On leave or removal: When a member leaves or is removed from the plan, their cloud data is purged from our servers at the end of the billing period. Data stored locally on their device is never touched.
- Notifications: Both the plan owner and the affected member receive push and email notifications when a member joins, leaves, or is removed from the plan.
6a. AI Coaching Feedback
Inside the app you can flag any AI coaching response as inaccurate by tapping the thumbs-down icon on a coaching result card or in the history view. When you submit feedback, we record:
- The reason you selected (e.g. wrong technique, missed the issue, no rep detected)
- Your optional written comment (up to 240 characters)
- The AI coaching text and metric scores you flagged
- The sport and prompt-template version that produced the response
- Your platform and operating system version (for diagnosing platform-specific issues)
By default the actual video clip is not included with your feedback. If you opt in via the "Include this clip" toggle, the cloud-stored video URL is sent alongside the feedback so the team can review the rep against the AI output. The toggle defaults to off and is hidden entirely if the clip isn't already cloud-synced.
Feedback is reviewed internally to improve the coaching engine and is never shared publicly. You can request deletion of your feedback by emailing support@apextrack.app.
7. Data Storage & Security
- Account data and performance metrics are stored securely using industry-standard encryption via our backend services (Supabase), hosted on servers in the United States.
- Authentication uses PKCE flow and secure token management.
- Biometric authentication (Face ID, Touch ID, fingerprint) is available for additional local security.
- All data transmissions are encrypted via HTTPS/TLS.
- Cloud data access is protected by Row Level Security — your data is only accessible to you.
- Data breach notification: In the event of a data breach that affects your personal information, we will notify affected users via email within 72 hours of becoming aware of the breach, in accordance with applicable law.
8. Data Sharing
We do not sell your personal data. We may share limited data with:
- AI service providers: Video frames for analysis (Google Gemini; not retained after processing).
- Payment processors: Apple (iOS App Store purchases) and Stripe (web purchases at apextrack.app) for subscription and top-up processing.
- Payout services: Cash App username shared only as necessary to fulfil a rewards cash-out you have requested.
- Tax authorities: As required by applicable law (e.g. IRS reporting for US users receiving $600+ in rewards).
- Analytics: Anonymised, aggregated usage data to improve the App. No personally identifiable information is included.
We will never share your personal data with third parties for marketing purposes.
9. Your Sharing Choices
You control what you share:
- Video highlight cards and GIF exports are created locally and shared only when you choose to post them.
- PDF reports are generated on-demand and shared only at your discretion.
- Your QR code and referral link are yours to share as you see fit.
10. Children's Privacy
ApexTrack is available to users aged 13 and above. Users under 18 require parental or guardian consent to create an account. Parental consent is specifically required for minors to participate in the referral rewards program. Parents can approve or decline consent via email verification. We do not knowingly collect personal data from children under 13. If we become aware that a user is under 13, we will delete their account and associated data promptly.
11. Your Rights
Depending on your jurisdiction, you may have the right to:
- Access the personal data we hold about you
- Request correction of inaccurate data
- Request deletion of your account and associated data
- Withdraw consent for data processing (including turning off cloud sync at any time, except on the Family Plan where backup is mandatory)
- Export your performance data
- Object to or restrict certain processing of your data

12. California Privacy Rights (CCPA)
If you are a California resident, you have the following additional rights under the California Consumer Privacy Act (CCPA):
- Right to Know: You may request details about the categories and specific pieces of personal data we have collected about you in the past 12 months.
- Right to Delete: You may request deletion of personal data we have collected from you, subject to certain exceptions.
- Right to Opt-Out of Sale: We do not sell your personal data. You do not need to opt out.
- Right to Non-Discrimination: We will not discriminate against you for exercising any of your CCPA rights.

13. Intended Users
ApexTrack is intended for use by residents of the United States only. The App is operated from the United States and all data is stored and processed within the United States. By using the App, you confirm that you are a US resident and consent to your data being processed in the United States. We do not knowingly offer the App to users outside the United States at this time.
14. Data Retention
We retain your account data and performance history for as long as your account is active. If you delete your account, we will remove your personal data — including profile, session history, trophies, wallet balance, referral data, and any cloud-stored videos — immediately and permanently, except where retention is required by law (e.g. financial records for tax compliance). Deletion cannot be undone. If your Unlimited or Family Plan subscription lapses, cloud-stored data is retained for 90 days in case you return, then permanently purged.
15. Third-Party Services
The App integrates with third-party services including Apple (iOS in-app purchases), Stripe (Android and web payment processing), and Google Gemini (AI analysis). These services operate under their own privacy policies, which we encourage you to review. We are not responsible for the privacy practices of third-party services.
16. Changes to This Policy
We may update this Privacy Policy from time to time. We will notify you of material changes through the App or via email. Continued use of the App after changes constitutes acceptance of the updated policy.
